The Federal Motor Carrier Safety Administration (FMCSA), standards help in safe guarding consumers’ interstate moves and describes the rights and responsibilities of consumers and household goods movers. Household goods movers who employ interstate movers must conform to the arbitration program requirements contained in 49 CFR 375.211.
Arbitration is an alternative to court action (litigation) and is a form of quarrel resolution and involves private, judicial determination of a disagreement by a self-governing third party. The arbitration hearing can use an individual arbitrator or a tribunal. A tribunal usually consists of a number of arbitrators, although some official systems insist on an odd number for the reason of avoiding a tie in the decisions made. One and three are the most common numbers of arbitrators. The contradicting parties hand over their power to decide the differences of opinion to the arbitrator(s) and their decision is final. A moving company which caters to interstate moves should offer an Arbitration Program to individuals who are moving. The customers however reserve the right to join in the arbitration program. On the other hand, they can request judicial verdicts through court actions under 49 USC 14706.
An Arbitration Program should have the following rudiments. First, they must prevent the moving company from fleecing the customer because his place of stay is far away. Before making a contract with the customer, the moving company must advise the customer of the availability of neutral arbitration. It contains basic information that a customer should know to understand various documents that movers will ask them to sign. It does explain also your privileges once your belongings got damaged or lost.
